ABH definition
any hurt or injury that interferes with with the health or comfort of the victim
Actus reus
That of assault or battery, occasioning actual bodily harm
Psychiatric
The harm can be psychiatric as in Chan Fook
Factual causation
‘but for’ the D committing the act, they would not have suffered the ABH
Legal causation
The D must be the operating and substantial cause meaning that there are no intervening acts which break the chain of causation
Mens rea
Intent or recklessness
