(a) can wait until as late as litigation to say you exclude certain groups
(b) have to IDENTIFY AS CORE IDENITY to be able to exclude certain groups of people
- LOOK TO ORGANIZATIONS CORE PURPOSE can discriminate if you identify as a core purpose or identity of organization
