Collective responsibility rule in conspiracy as a means of incurring criminal liability

A

It’s the doctrine that once conspiracy is established, each conspirator is held equally liable as a co-principal for acts committed in furtherance of the conspiracy. In effect, the act of one is considered the act of all.

Requisites for incurring criminal liability in conspiracy

  1. there must be conspiracy to commit a crime
  2. the crime agreed upon has been committed
  3. conspirators have performed an act in furtherance of the conspiracyXP: the 3rd requisite may be disposed of if the conspirator is the mastermind.
    In which case, the inducement must have been the determining cause for the performance of the crime.
