5 steps of GNM?

A
  1. DoC must be established
  2. Doc must have been breached
  3. Breach must create risk of death
  4. Breach of duty must cause/make significant contribution to V’s death
  5. Negligence established must be considered ‘gross’ by jury

a mere voluntary intervention may not itself be sufficient enough to form a duty of care, a combo of factors may need to be present
