- A candidate for a party is NOT an elected official. “Democrat candidate” is NOT a government position.
The Democratic Party (formally the Democratic National Committee or DNC) is a private, nonprofit political organization, not a government agency.
It is free to set its own internal rules for selecting delegates, holding primaries/caucuses, and nominating candidates—subject only to state and federal election laws (e.g., campaign finance rules, ballot access).
The same applies to the Republican Party (RNC). Neither is “the government,” even though they play a central role in the electoral process.
Court precedent: In cases like Democratic Party of the United States v. Wisconsin (1981) and California Democratic Party v. Jones (2000), the U.S. Supreme Court has affirmed that political parties have First Amendment associational rights to control their own nomination processes, reinforcing their private status.
- The people still got to vote for Harris or reject her. When they rejected her, she conceded.
- A party picking their own candidate is different than the losing candidate trying to attack and steal the general election.
- Harris being appointed didn’t break any rules or laws. She was given the delegates because of Biden’s endorsement and they officially nominated her at the DNC. Trump was actually indicted on felony counts of conspiracy to defraud the United States and conspiracy to obstruct an official proceeding.
- Choosing Kamala was objectively defensible because of the unique situation with Biden stepping down. There was a pretense for them to nominate someone quickly with 3 months left in the race. Trump had zero defensible position to try to overturn the 2020 election.
When Trump Voters Say Harris Not Having a Primary was Anti-Democratic
Don’t pretend to care about that. If you voted for Trump, and are informed about what he did, do you really care about democracy?
