Q

Who is best to apply for grant of probate?

A
  • Executors named in the will
  • If no executor: residuary legatees/devisees
  • Then other beneficiaries

The representative of a deceased beneficiary’s estate is not the best person to apply because entitlement to a grant flows from the testator’s will or intestacy, not from the beneficiary’s estate. They only have an indirect interest and rank very low in the probate priority list.
