**RIGHTS OF ONE PARTY mustnt VIOLATE THE RIGHTS OF ANOTHER PARTY (3)
- parties have rights but t rights 1 party may be limited by the rights of the other, + vice a versa
- both parties should respect each others rights
- rights have corresponding duties
- the function of the law is to restore the legal balance;…learners right to freedom of expression is limited to protect the educators dignity (eg when the learner uses vulgar language when speaking to the educator in the educator-learner relationship)
SACE’S FUNCTIONS +POWER (10)
SACE strives to:
- establish min criteria + procedures for registration -educators
- keep register of names of all persons who registered
- promote professional development
- establish a code of professional ethics
- establish a fair inquiry procedure +appoint a committee to investigate any breach of code of professional ethics
- advice regarding distribution of teachers
SACE has the power to:
1. caution / reprimand
2. impose a fine not exceeding one months salary on or
3. strike from the register the name of an educator found guilty of a breach of the code of professional ethics +may suspend a sanction imposed in terms of (2 + 3)
• subject to the approval of the minister, - determine compulsory monthly fees payable to the council in respect of educators for whom registration with the council is compulsory
• advise the minister on any relevant aspect if so requested by the minister
• appoint staff + determine their conditions of service
• establish committees + assign functions to them
EDUCATORS PROFESSIONAL STATUS? (5)
- depends on image community have of educator (power, prestige, income)
- profession image is made up of their own view of self +how they think others view them
- depends on personality, training, service to the community, career success, maintenance of a professional code of conduct + financial welfare
