- Knowingly disregarding one’s duty as a driver
- Deliberately running an unjustifiable risk of injury or collision

- Knowing trying to outrun a police car at night and turning off headlights
- Driving through a stop sign at 80-100kms that the driver knows of and wouldn’t be able to stop even if they wanted to

Explain section 114 of the Land Transport Act 1998
Only for enforcement of LTA. Not a general stopping power
An officer, in uniform (Or hat) can signal a driver to pull over or use lights/Sound siren and demand the driver state:
- Name, Address, DOB, Occupation, Phone
- Wether they are the owner
- If not the owner: The name and address of the owner
Arrest if:
- Fails to stop
- Refuses to supply details
- Supply’s details that I have GCTS are false

DIMDFFD
Direct: a person to give

- Information to identify the driver or person in charge of vehicle
Inspect:

Move Vehicle:
- if it is causing obstruction to road or property entrance
- Can enter vehicle (Or get another person to)
- Can generally move the vehicle

- The driver or person I’m charge to move the vehicle

- An unlicensed driver to drive a motor vehicle

- A person operating a transport service without license to not do so

- A person driving a vehicle or animal into a line of traffic or direction

Explain Section 115 of the Land and Transport act 1998:
This power allows an enforcement officer to prohibit vehicles from being driven on a road if you have RGTB a vehicle fails to comply with regulations.
116 Gives me the power to arrest if somebody fails to comply with directions under 115
Explain section 121 of the Land and transport act:
RGTB that a driver is:
- Impaired (Physical mental condition)
- Has failed a Compulsory impairment test
- Refuses to do a CIT
I can carry out FARMED
- Forbid the person to drive for a specified Time
- All keys to be surrendered
- Render the vehicle immobile
- Move the vehicle if causing obstruction
- EBA offenders forbidden to drive for a 12 hour period
- Direct the person to drive to a specific place to rest if the exceed their driving hours (Trucky etc)
Explain the purpose and explanation of Section 118 Land Transport Act 1998
Officer may require and owner or hirer of any vehicle to give, within 14 days, all information available which may lead to:
- Identification and apprehension if the driver has committed any offence against any act while operating the vehicle
- The above regarding the passenger if they have commuted/aided/avoided arrest in or through the use of the vehicle.
The person must have been the owner at the time of offence and the info required must be within the owners ability to supply
Explain section 122 of the land and transport act
If you have RGTB that it is in the interest of public safety, you can impound/seize a vehicle for 12 hours.
This can be extended further if circumstances haven’t changed

What circumstances do I suspend a persons drivers license under section 95 of the land and transport act?
28 Day suspension if:
- The person has an breath alcohol of over 650mcg per litre of breath
- The person has a Breath alcohol over 400mcg per ltr of breath AND has been convicted of a relevant offence within 4 years
- The person has a blood alcohol over 130m per 100ml of blood
- The person has 80mgm of alcohol per 100ml of blood and has been convicted of a relevant offence within 4 years
- The person has failed/refused a bloody test under S72 and S73 of LTA
- The person drives a vehicle 40kph over the sped limit
- The person drove 50kmh over a temporary speed limit
What circumstances would police have to impound vehicles under section 96 of the Land transport act 1998
- They are disqualified from holding a license
- They have a suspended or revoked license
- The person has an alcohol interlock license and broke the conditions of that license
- Drive a vehicle to race or in an unnecessary exhibition of speed
- Caused the vehicle to have a sustained loss of traction
- Failed to remain stopped under section 114
- Failed a lower Breath and Blood test having had two previous convictions for any relevant offence in the last four years.
- Refuses a blood test having had two previous convictions for any relevant offences in the last four years
What is the purpose of demerit points
Suspension from driving over accumulated offences
What is a demerit point suspension notice?
If you have accumulated 100 or more points with a two year period, you will be suspended for 3 months.
After this time you must reinstate your license
What’s an unsafe vs defected vehicle?
Unsafe: e.g RGTB car is not in a safe condition to be driven on the road I.e illegal modifications or structural rust. Pink
Defective: RGTB Fails to comply with regulations and rules I.e. Defective Exhaust, Tinted windscreen. Green Sticker
