Processing for Obtaining Study Permit

1. Accepted for Study at DLI
2. Obtain a letter of acceptance from DLI
3. Apply for a study permit (and TRV if needed)

• if they hold an existing one and would like to extend (starting from 90 days to the expiration date)
• hold a TRP that is valid for at least six months and would like to study
• subject to an unforceable removal order
• a family member of the FN that has been approved to come into the country

R. 188 (1)(c): studies of less than six months do not require study permits

Answer 4

Accompanying family members can be exempt from having an acceptance letter, as long as the applicant recieved writen approval before entering Canada.

Question 5

Study Permits for Minors

No study permit is required for elementary or high school or if they are children of refugees or to those that are permitted to be in Canada.

However, when they reach the age of majority they will have to apply for a study permit if they would like to continue their studies.

Duration of Study Permit

Valid for the length of the study program plus an extra 90 days.

However, study permits issued at the college the university level will become invalid 180 days after the completion of the program because that would be the same deadline as the PGWP (Post grad work permit) application

Extensions

May apply for an extension if the following are met:

• application is made before the expiration of the current permit r. 217 (1)(a)
• all conditions imposed upon entry into Canada has been complied with (r. 217(1)(b))
• the student is in compliance with the eligibility criteria for a study permit s. 216 A

An student is able to continue studying with “implied status” if application for extension was done prior to the expiration of the permit, as long as

• the student remains in Canada since the expiration of the permit
• the student continues to comply with the conditions of the original permit

If a student departed Canada during the implied status, they may re-enter as a temporary resident, pending a decision, provided that they are TRV exempt

Question 9

Students: Work Permit Not Required

• On Campus Work*
• Off-Campus Work*
• must have a valid study permit and must be enrolled in school full time
• are permitted to work up to 20 hours per week during regular academic sessions and full time during scheduled breaks, as well as during the transitional period to post graduation work permit

** Students are able to work off campus 20 hours a week but also may work on campus

Student : work Permit Required

• Humantarian Reasons*
• R 208- students may apply for work permits if for reason beyond their control that they become desitute
• they will become granted an open work permit, and typically valid for he duration of the current term of study and not for the entire study permit. They will have to reapply for subsequent terms
• Post Graduate Work Permit*
• -* graudates from post secondary school may apply
• the employer will be exempted from having to register the job offer

The student is not eligiblein the following conditions

• the program of their studies was less than 8 months
• have previously been issued a PGWP
• completed the program where distance learning made up more than 50% of the program

To quality:

• must have continuously studied full time in Canada
• must have written proof that they have finished the program
• must apply for the permit within 180 days of written confirmation
• if they student had left canada they can still apply for the program
• In Canada: can apply to restore their status as a student to apply (if there are in Canada on an expired permit)

If the student had applied, they are permitted to work full time until the IRCC renders a decision

• the new permit cannot exceed 3 years and once the PGWP expires,they student must apply for a LMIA and a work permit to qualify under a different program
• Co-Op Or Internship Program*
• may be issued a work permit if a co-op is an integral part of their program of study
• the co-op/internship cannot be more than 50% of the total program of study
