What is automatism?

A
  • An act done by the muscles without any control by the mind, such as a spasm, a reflex action or a convulsion
  • OR an act done by a person who is not conscious of what he is doing such as an act done whilst suffering from concussion/sleep walking

A

Loss of control by the mind over movements of the body (reduced/partial control is not enough)

Specific intent offences (self induced automatism)

  • Intention must be proved (murder, s.18, theft)
  • Self induced automatism is a defence if D has not formed the intent needed for the crime

  • Recklessness is enough (manslaughter, s.20, s.47)
