A
  1. Must be established whether there was unfair discrimination.
  2. If there was, must be established whether based on listed ground. If so, unfairness is presumed.
  3. If discrimination not based on prohibited grounds, differentiation may still amount to unfair discrimination if it can be proved.

  1. Employer must consult in TU or reps who must reflect the interests of employees across all categories of the employer’s workforce.
  2. Must conduct analysis of its employment policies, procedures and working environment in order to identify employment barriers which adversely affect designated groups.
  3. Employment equity plan must be put into place.
  4. Must report annually to the director General on the progress made with the implementation of the plan.
