Case law related to impaired driving investigation

A

R.v. Stellato- Investigator needs to formulate reasonable grounds of impairment.
R.v. Graat- A layman or police officer may give his opinion based on his own observation if the accused’s ability to drive is impaired.
R.v. Edson- a qualified breathalyzer technician is not, without further credentials, capable of relating the defendant’s reading to his ability to operate a motor vehicle.
R.v. Pelletier- an accused may be convicted although his impaired condition is partly due to fatigue and partly due to consumption of alcohol.
R.v. Penno- drunkenness is no defense to the charge of impairment.

If it is proved that the accused occupied the seat or position ordinarily occupied by a person who operates a
conveyance, the accused is presumed to have been operating the conveyance unless they establish that they did not occupy that seat or position for the purpose of setting the conveyance in motion.

De Facto Care or Control

A

R.v Ford
De Facto care or control is established when the impaired person performs some act or a series
of acts involving the use of the conveyance, its fittings or equipment, whereby the vehicle may
unintentionally be set in motion. This must be a realistic danger.
