How does competency differ from capacity?
Competency is the ability to understand information about your health and treatment plans and make decisions based on that information. It is a legal determination.
Capacity is similar but refers to your ability to make a decision about your treatment at a specific point in time. It is a clinical determination made on a case-by-case basis and determined by the clinician porposing the treatment.
An individual who is able to understand the nature and anticipated effect of proposed medical treatment and alternatives, and to appreciate the consequences of refusing treatment, is considered to have the necessary capacity to give valid consent.
