Tow hearings:

  1. Commanders shall honor a request for post-storage hearing within 10 days of the date appearing on the notice.
  2. Commander shall designate a lieutenant or sergeant to be hearing officer.
  3. The hearing shall be conducted within 48 hours of the request, exclusing weekends and holidays.
  4. Failure to request a hearing or fail to appear at the post-storage hearing shall satisfy the request.

How much money can be stored in evidence safe?

When does an evidence officer get called in?

A

Money in excess of 1,000 dollars, seized as evidence of for safekeeping shall not be stored in a temporary evidence locker/cabinet (including pass through cabinets). The money shall go directly into the evidence room safe, an allied agencies evidence room safe, or a safety deposit box (cash only) at a financial institution.

During normal business hours the area evidence officer, alternate, or Area commander shall be notified immediately to secure and process these items - Outside of normal business hours one of the aforementioned shall be notified and respond.

It is at the Area Commander’s discretion to determine a threshold amount of money the Area will maintain in its safe within the evidence room. The OIA strongly encourages money be sent to fiscal management Section for storage as soon as reasonably possible in order to minimize the Areas risk. This includes money received as evidence, safekeeping, and found. Money received and booked as safe keeping with a likelihood of being returned to the owner within a short period of time should remain at the area

*Before sending money to FMS, authorization shall be obtained from the district attorney prior to transferring or converting money booked as evidence prior to adjudication. This money shall be placed into an interest bearing account.

Subpoena - when can/can’t you serve FMLA /injury/rdo/sick

A

Unavailability of Officer: If the subpoena is for an officer who is not available at the time of service because of absence due to vacation, leave of absence, military leave, regular days off, or other sufficient reason, such fact shall be made known to the process server.

The immediate superior of designated agent shall refuse to accept service of the subpoena. The date of expected return to duty should be given.

An employee on sick leave or injury status is NOT considered unavailable for service.

If, with this knowledge the process server insist upon leaving the subpoena, the immediate superior or designated agent shall immediately contact the attorney at whose request the subpoena was issued. The subpoena shall then be returned to the attorney

If unable to contact the subpoenaing attorney and there is not sufficient time for a letter to each the attorney prior to the appearance date, the officer’s immediate superior shall appear at court on the appearance date and apprise the judge of the officer’s unavailability.

Commanders shall not pay the GC 29601 and 29602, county or city in which arrest is made is liable for this cost.

When a county refuses pay commander shall attempt to resolve the issue at the local level.

The area commander should remind the county/city they are responsible. This is not excused if there are no funds. We have not statutory authority.

If not resolved at the area level, the division commander should request assistance from OLA.

Employee Eligibility. (1) To be eligible for FMLA/CFRA benefits, an employee must have at least 12 months (52 weeks) of state service, and have worked at least 1,250 hours (actual time worked) immediately before the date the FMLA/CFRA leave is to start. (a) The hours do not need to be worked consecutively. (b) Time off for sick leave, vacation/annual leave, administrative time off, compensating time off, holidays, informal time off, or personal leave are not counted towards the 1,250 hours of work. (c) Overtime hours are counted. (d) Time off for military leave is counted. (e) Union Paid Leave may count. (f) Any paid leave due to job-related injuries or illness will not be counted towards satisfying the 1,250 hours worked requirement. The 12-month period is measured backwards from the date an employee uses any FMLA/CFRA leave. (2) The determination of an employee’s eligibility is made as of the date the leave commences. If an employee reaches a 12-month eligibility requirement while on the leave, the leave period prior to meeting the requirement is non-FMLA/CFRA leave. (3) Refer to Annex E for special rules for returning reservists under the Uniformed Services Employment and Reemployment Rights Act. (4) Part-time and permanent intermittent employees are eligible for an FMLA/CFRA leave if they meet the 1,250 hours of service and other qualifying conditions.
