What is the scenario structure for robbery?
AR of theft (R V Robinson)
Force/ threat of force (Dawson and james) (RP V DPP) ( R V Bentham)
On any person (R V Clouden) (R V Smith and Desmond)
In order to steal (R V Corcoran and Anderton)
Immediately or before time of stealing (R V Hale) (R V Lockley) (R V Vinall)
MR (dishonest and intentional to use force to steal)
What happened in the case of R V Robinson
D brandished a knife to a man who owed him £7’s wife, D snatched £5. D had genuine belief he had a right to that money=no dishonesty=no theft=no robbery
What happened in the case of R V Corcoran and Anderton.
D hit V in back and grabbed bag, it fell and V screamed so D ran away without bag
Showing D doesn’t have to get away with property
What happened in the case of Dawson and James
1D nudged V so he lost balance, 2D was behind and took wallet.
This made it clear that even a slight nudge was force
What happened in the case of RP V DPP
D snatched a cigarette from V’s fingers, didnt amount to use of force
What happened in the case R V Clouden
Wrenching a hand bag constituted as force, as applying force to bag=applying force to V
What happened in R V Smith and Desmond
If D threatens/attacks V to steal property belonging to a diff person it is still robbery
What happened in R V Bentham
D broke into V’s house demanding Jewellery and used his fingers to fake a gun. Doesn’t matter there was no gun, fear of force was enough and was guilty.
What happened in R V Hale
2 D’s broke into V’s house, 1 covered her mouth while other stole jewellery. Tied her up after. Held the appropriation was a continuing act and they were convicted
What happened in R V Lockley
D was shoplifting, shopkeeper tried to stop him so D used force to get away. D was guilty as its a continuing act
What happened in R V Vinall?
D2 punched one of V’s off bike and claimed he had a knife, D1 chased other V who left his bike behind. Not guilty as the the force can’t take place before the theft
