Evidential Breath Test (Fail)
- u20 — 1 to 150 = ION s57(1A)
- 20+ — 250 to 400= ION s56(1A)
- u20 — OVER 150: positive test advice (10 mins) If accept breath - summons under s57(1)
- 20+ — OVER 400: positive test advice (10 mins) if accept breath - summons under 56(1)
- 20+ — OVER 400: positive test advice (10 mins)
Blood test
“I know require you to undergo a blood test”
Can do if
- evidential breath test is unavailable
- driver refuses or fails to undergo the EBT
- “incomplete” test results is obtained
- positive result returned and driver elects to have blood sample taken

- Use Sec 121 to forbid
- Suspend 28 days under s95
