Q

What did the British westinhouse v Undergorund Electric railways state regarding the duty fo care and a contractors responsibility to accelerate works?

23
Q

Within the JCT Contract, what does it state that the Contractor’s obligatiuon to delay?

A
  1. Duty to prevent delay
  2. Duty to prevent further delay
24
Q

Can a contractor choose to accelerate the works on their own decision?

25
What are some methods to ensure that the contractor meets the new acceleration date?
1. Sign a warranty with the contractor 2. Set financial incentives 3. Monitor Milestones 4. Ensure that the measures proposed are appropriate
26
What is the risk of asking the contractor to sign a warranty to meet the new Completion date?
comes with a premium
27
If the accleration measures are not working, what might they do?
1. Revert back to the old contract
28
Before accepting a Accleration quotation, what should be definded?
1. Practical completion - What is essential at handover
29
How is acceleration achieved?
1. Contractor / employer have to make changes to current system
30
What are some things that a contractor may be able to change?
1. Site working hours 2. The level of resource deployed 3. The programme and sequence of working 4. The Tempoary works 5. Methods of Working
31
What can the employer change?
1. The specification 2. The design 3. The works scope and conditions of working
32
What is Extending working hours? (1)
1. Longer working hours - 6am to 18:00pm 2. Weekend working 3. Working public holidays
33
What does increasing resources mean? (2)
1. Increase the number of staff on site 2. Increase the amount of plant (Forklift)
34
What are some examples of resenquencing or altering the programme? (3)
1. increase the amount of overlap of tasks and trades
35
What is an example of introducing tempoary works? (4)
1. When working outside - they could weather protection or shelter 2. Errect more scaffoldingWhat is so
36
What are some methods of working methods? (5)
1. Floodlighting 2. Generators 3. Dehumifiers
37
Is Acceleration a supplemental provision?
Yes - you need to tick yes or no on whether it applies
38
Does the formal completion date change with acceleration?
Yes
39
Can the client still claim LD's if they choose to use Acceleration?
Yes
40
Why may night shifts not be usable?
Light pollusion and noisy works - Council might not permit it
41
What is constructive acceleration?
Disputed scenario when EOT refused and contractor speeds up to avoid LDs.
42
Where do you find acceleation discussed in the JCT D&B contract?
Schedule 2 Supplement provision 4
43
What is the critcal Path?
The critical path is the longest chain of logically linked activities in the programme that determines the earliest possible completion date. Activities on the critical path have no slack—any delay to one delays completion
44
What are the three different ways of pricing accelleartion?
1. Lump Sum 2. Itemised Breakdown 3. Assessment based on actual costs
45
When would a lump sum quotation be used?
If all the risk is to be placed on the contractor, it may be better for a lump sum quotation to be provided, although this will make it difficult for the employer to assess the merits of the quotation. It may be that the employer is far less concerned about whether individual elements of the contractor’s quotation appear to be high and more about whether the money that can be saved by completing early justifies the money that will have to be spent on acceleration.
46
What arew the risks of pricing the quotation on "acutal cost"
1. Disputes on whether certain costs were incurred becasue of acceleration measures 2. Will not know the extent of costs until after the works are complete
47
When considering Acceleration, what are some questions you should ask?
* Does the contract allow for acceleration? * Is a separate agreement required? * How can acceleration be achieved? * Is the activity to be accelerated on the programme’s critical path? * What is the total cost of acceleration? * What costs will be saved by achieving an earlier completion date? * How is failure to achieve an earlier completion date to be dealt with?
48
What was the overall duration and programme of the project? | Case Study
Early March - Mid August 19 weeks
49
So how long did you have to do the VE workshop? | Case Study
Just under 4 weeks
50
When did you present the three options to your client? | Case STudy 1
Mid January
51
Why didnt you have time to do a cost plan whilst doing a VE workshop? | Case Study
Did not have enough to complete a comprehensive cost plan. Reviewed measures andr rates of key packages such as: - wall finishes - Floor finishes - Ceiling - MEP Checks - Prelims/OHP My advice was that if we were brought on to do a cost plan then it could take away time for reviewing VE Workshops and we would not be any further in the process of achieving the savings if our estimate was similar.
52
# Louis For option 2, why did you not sure a gaurenteed maximum price? | Case Study
This was reviewed, however the contractor was not willing to accept the risk as they could ultimately not gaurentee that the VE proposals were going to be agreed by the client.
53
# VE Nr 1 Please provide the breakdown of the saving for the Acoustic lourve for the Louis manchetser project | Case Study
