What did you learn when listening to the Unveiling RICS conflict avoidance procedures (CAP) ?
During this podcast I learnt about the dispute resolution procedure that RICS provides and how it can be utilised as a form of ADR. CAP can be a quicker process than adjudication where the CAP panellist can provide a recommendation for the parties to follow or not as it is not binding
What did you learn in the carbon reduction CPD?
I learnt how our internal sustainability team undertake energy audits which include reviewing the current building elements and where energy savings could be made. For example replacing windows with double glazing to minimise heat loss
What did you learn during the RICS podcast on Carbon reduction in the built environment ?
An insight into the new leading energy standards to revolutionise carbon reduction in the built environment. This includes focussing on the Whole Life Cycle Assessment, which mandates consistent measurement and reporting of carbon emissions throughout a buildings entire lifecycle
What did you learn in the procurement trends CPD?
That there is a shift towards outcome based procurement focussing on delivering value behind just construction. Collaborative procurement is on the rise and the procurement act 2023 has led to positive sentiments about improving outcomes for clients
What did you learn in the RICS “what needs to change in the build environment” podcast ?
An overview on equality in PPE provision, diversity and inclusion; an insight into retrofitting large scale projects to achieve net zero.
What did you learn in the RICS recorded webinar on Anti- money laundry?
I learnt that the risk of bribery, money laundry and terrorist financing are global challenges that impact our profession.
I am aware of how The Financial Action Task Force (FATF) is the global money laundering and terrorist financing watchdog.
RICS provides “The Red Flag Indicators” document outlining the five main categories that professionals need to be aware of including :
- the client
- the parties
- the source of funds
- the transactions
- the instructions

What is the adjudication timeline ?
1) party serves a notice to the other party of the intention to refer to adjudication
2) within 7 days of the notice, the referring party must serve the other party its referral (statement of the case)
3) within this 7 day period, the referring party must secure the appointment of an adjudicator
4) following appointment, the adjudicator will set out a timetable
5) adjudicator makes his decision within. 28 days of the referral
Can the decision period for adjudication be extended?
It can be extended to 42 days if agreed by both parties
How is the name of the adjudicator agreed?
What is adjudication ?
Allows a construction contract dispute to be resolved more quickly and cost effectively compared to arbitration or litigation.
What is the difference between arbitration and litigation ?
Arbitration - essentially a lawsuit but without court involvement. The arbitrators decision is legally binding. This process is private
Litigation- commencing a claim in the civil courts. This court is the Technology and construction court. Proceedings are generally conducted in public
Difference between arbitration and adjudication?
Arbitration is a slower process whereas adjudication the decision is made within 28 days.
Adjudication decision is binding unless appealed via arbitration or litigation
Arbitration the decision is final and legally binding with limited appeal rights
