What happens if the defendant is intoxicated?

A

Voluntary intoxication will not be considered a recognised medical condition as established in Dowds

If D has a medical condition and is intoxicated the jury must decide whether the defendant has satisfied them that despite the drink his mental abnormality substantially impaired his mental responsibility for his acts

Intoxication due to addiction is considered involuntary and therefore can be a recognised medical condition
